TERMS & CONDITIONS

Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is limited to NSW, VIC, WA, SA and QLD residents who are Optus consumer residential customers ("Entrants"). Employees (and their immediate families) of the Promoter and its agencies associated with this promotion are ineligible to enter. You must be under 18 years old in order to attend the event.
3.
To be eligible to enter, individuals must register with 'Yes' Tickets or be currently registered with 'Yes' Tickets. To enter, individuals must visit either www.yessessions.com.au or www.yestickets.com.au, follow the prompts to the competition entry page, and answer in 25 words or less "What is your favourite Pink song and why?" and submit the fully completed entry form for their chance to win during the promotional period. This is a game of skill and chance plays no part in determining the winner.
The most creative entries from the State/territory group will each win 1 double pass to the 'yes' sessions Pink under 18's concert in their capital city. There is a total of 200 double passes per state to be won.

Promotion commences Sunday 1 March 2009 at 09:00 (AEDST) and entries close at Sunday 3 May 2009 at 23:59 (AEDST) ("Promotional Period"). The most creative answers will be chosen. All valid entries received during the Promotional Period will be entered into judging to be held on Wednesday 6th May 2009 at 3pm (AEST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113 to win a double pass to the following Pink Yes Sessions under 18 concerts:

- Saturday, June 6 (50 double passes)
- Sunday, June 7 (50 double passes)
- Tuesday, June 9 (50 double passes)
- Wednesday, June 10 (50 double passes)
Brisbane Entertainment Centre

Winners will be contacted by email and mail.

The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Incomplete or indecipherable entries will be deemed invalid.

Only 1 entry permitted per person.
8.
If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
9.
The prize includes: 1 double pass to a 'yes' sessions Pink under 18s concert in your closest capital city.
- Winner must be under 18 and have permission from their parents to attend the event
- This prize is non-refundable or transferable and must be taken at the scheduled event in your capital city.
- Winner is responsible for all travel and associated costs to attend the Pink event.
- The Promoter takes no responsibility and or will not incur any associated costs for any cancellations or amendments to 'yes' sessions Pink under 18s concert.
10.
All winners will be notified in writing/email. The Promoter's decision is final and no correspondence will be entered into.
11.
Entries will be divided into the following State/Territory groups: NSW, VIC,WA, SA & QLD. Each winning entry will receive one (1) double pass to attend the 'yes' sessions Pink concert in their capital city, valued at $173.80 including GST. Winners will be responsible for all costs associated with attending the event including transport to and from the specified venue.
12.
Any ancillary costs associated with redeeming tickets are not included.
13.
Unless specified otherwise, if for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize will be forfeited.
14.
The ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
15.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
16.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
17.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
18.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the selected event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
19.
Entrants consent to the Promoter using the Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter, and its related bodies corporate, may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. By accepting the terms and conditions you understand that any content deemed unacceptable will be removed from the site.
Content is deemed unacceptable if:
- contributions that include profane, explicit, abusive, harassing, and discriminative or libellous material
- contributions that include or link to illegal content
- contributions that publish personally identifiable or otherwise sensitive information, images, video or sound
- contributions that embed content that infringes on the intellectual property of another, such as copyrighted images, sound or video
- contributions that expose children to inappropriate or unsuitable content, including but not limited to pornography, hate groups, violence, illegal activity, extremist groups and cults and certain forms of online advertising
- contributions that promote petitioning or that rally other users in a negative way.
